An Osceola County sheriff’s deputy was convicted Wednesday of battering a man in custody last year.

It was back in May 2021 when Deputy Dirio Sinclair was caught on camera allegedly punching a suspect who was undergoing medical care before being arrested.

He faced misdemeanor battery charges after admitting things got out of control.

“On May 6 of (2021), our agency responded to a hotel off of west 192 in reference to a violation of injunction,” said Major Dan Weis with the Osceola County Sheriff’s Administrative Bureau.

Weis said when deputies arrived at the hotel, they handcuffed the suspect, whose name hasn’t been released after he violated an order regarding a domestic violence case.

When they put him in the patrol car, he injured himself.

“He became violent, hitting his head in the patrol car, causing an injury. So we transported him to AdventHealth,” Weis said.

That’s where the incident happened.

The Osceola County sheriff said the patient was trying to stand up by pulling on the rail he was handcuffed to.

When Sinclair ordered him to lay back down, the two started arguing.

We’re told the suspect was antagonizing Sinclair before the physical altercation.

After body cam video and video from the hospital were reviewed, a criminal investigation began.

Aside from minor damage to an agency vehicle, Sinclair had a clean record.

He was on administrative leave without pay and the sheriff’s office said it’s begun the termination process.
