Allahabad High Court directs Farrukhabad Basic Education Officer to issue appointment orders within 6 weeks

The Allahabad High Court ordered the District Basic Education Officer, Farrukhabad, on October 21, to issue nominations from NIOS to the D.El.Ed diploma holders within 6 weeks.

A single bench of judges, Ashwani Kumar Mishra, issued this order when hearing a petition from Deepak Kumar Shukla.

In this case, the petitioner was selected for appointment as Assistant Teacher, but the appointment was not given solely on the grounds that the petitioner’s Diploma in Elementary Education (D.El.Ed.) was awarded by the National Institute of Open School ( NIOS).

The District Commissioner for Basic Education appears to have sought some clarification as he is uncertain about the status of the applicant’s diploma, the court found.

Dhananjay Awasthi, lawyer for the defendant NCTE, makes a categorical statement in court that the NIOS diploma in elementary education is already recognized by the NCTE (National Council for Teacher Education).

The court stated that, given that the petitioner’s diploma has been recognized by the NCTE, there is no reason for the District Basic Education Officer not to consider the petitioner’s request for appointment.

Such an order in relation to the petitioner’s candidacy would be issued in the light of the above observations by the defendant within six weeks from the date of submission of a copy of the order, the court order.

Accordingly, the court rejected the written application.
